Why a written rental agreement matters
Even the best word-of-mouth arrangement collapses when rent is delayed or the tenant refuses to vacate. A written, stamped and (for longer terms) registered rental agreement is the single most powerful document in any Indian rental dispute.
The 14 clauses you cannot skip
- Parties — Full legal names, Aadhaar numbers, addresses.
- Property description — Full address, unit no., floor, super built-up area, number of rooms.
- Monthly rent — Amount in words and figures, due date, payment mode (UPI/bank/cash).
- Security deposit — Amount, refund conditions, deduction rules.
- Duration — Start date, end date, whether renewable and how.
- Lock-in period — Minimum months during which neither party can exit without penalty.
- Notice period — Typically 1-2 months. Symmetric for both sides.
- Maintenance charges — Who pays society/CAM charges.
- Utilities — Electricity, water, gas, internet — separate or included.
- Rent hike — % or fixed amount at renewal (usually 5-10% annually).
- Permitted use — Residential only? Home-office allowed? Any restrictions.
- Repair responsibilities — Major (landlord) vs day-to-day (tenant).
- Vacation clause — Handover condition, painting, cleaning charges.
- Jurisdiction — Which city's courts will settle disputes.
Stamp duty, notarisation & registration
Every state has its own rules:
- Maharashtra — Registration compulsory even for 11-month leases.
- Karnataka — Only 12+ months lease needs registration; ₹100-500 stamp is common.
- Delhi — 12+ months must be registered; stamp duty 2% of average annual rent.
- Tamil Nadu — 12+ months need registration; 1% stamp duty.
The classic "11-month agreement" trick — used everywhere to avoid registration — is legally valid but weaker in court than a registered lease.

What to do next
- Print on the correct stamp paper (buy from a licensed vendor or eStamp.karnataka.gov.in / shcilestamp.com).
- Both parties sign every page. Add 2 witnesses.
- Notarise (for 11-month leases) or register at the local sub-registrar (for 12+ months).
- Keep the original with tenant, colour scan with landlord, one copy with the RWA.
Skipping registration seems cheap but costs 10× more if you ever go to court. Do it right the first time.
